Fraud

Fraud is calculated dishonesty, in order to gain an advantage. It commonly occurs when one person deceives another by words or conduct, for personal or financial gain. Fraud is defined legally in the Criminal Code of Canada under Section 380 (1). If you were found guilty of fraud, the court would weigh the following factors: 

  1. the scale, complexity, length or degree of planning the fraudulent act
  2. the offence negatively affected, or had the potential to negatively affect, the stability of the Canadian economy or financial system
  3. the offence involved a large number of victims; the offence had significant impact on victims, and their personal circumstances
  4. the offender took advantage of the high regard in which the offender was held in the community
  5. the offender did not comply with a licensing requirement, or professional standard, that is normally applicable to the activity of the offence
  6. the offender concealed or destroyed records related to the fraud or to the distribution of the proceeds of the fraud​
